Using modern methods of assessing the impact of legislative acts

Tashkent, Uzbekistan (UzDaily.com) -- On 25 November 2015б Tashkent hosted an international seminar on: “Using modern methods of assessing the impact of legislative acts on the course of social and economic reforms”.
The event was organized by the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan, the Institute for monitoring of current legislation under the President of the Republic of Uzbekistan jointly with the representative office of the Konrad Adenauer Foundation, the Asian Development Bank and the UN Development Program.
The seminar that has attracted much public attention was attended by deputies of the Legislative Chamber of the Oliy Majlis, responsible workers of the Cabinet of Ministers of the Republic of Uzbekistan, ministries and departments, heads and specialists accredited in Uzbekistan, international organizations, international and national experts of relevant fields of law, representatives of the mass media and other civil society institutions.
In his report at the joint session of the Legislative Chamber and the Senate of the Oliy Majlis of the Republic of Uzbekistan (23.01.2015) President of Uzbekistan Islam Karimov, defining priority tasks of Parliament of the country as part of improving activities, fundamental, taking into account modern standards, improving the quality of legislative activity noted: “... often adopted laws, amendments and additions to them do not work due to the fact that, firstly, they do not contain specific mechanisms for implementing the existing norms, and secondly – relevant legislative acts are not published or not timely issued, without which the provisions of these laws simply can not operate.
In this regard, the question arises why the framework laws that our Parliament “likes” to adopt, do not “land”, are not brought to the end, to law enforcement.
I think one of the main reasons here is that, while adopting the law, we do not ask the question that should be put in the course of its development. Namely, to what extent, how effectively the law will work in real life. And it causes duplication and contradictions found in our legislation, reduces its effectiveness”.
Implementation of tasks defined by the President of the country requires the implementation of systematic and scientifically-based measures aimed at studying quantitative and qualitative changes taking place in public life with the adoption of a law as they affect the development, the progress of socio-political, socio-economic, judicial and legal reforms.
And in this respect it is important to study and implement effective international experience in implementation and functioning of the assessment system of the impact of legislative acts and inventory of the state of development of these processes in Uzbekistan and identify priority ways and forms of their development.
The purpose of the seminar was to further develop and improve the quality of legislative and regulatory activity of Parliament of the country, due to the widespread introduction of modern methods of assessing the effectiveness of law enforcement, comprehensive accounting of results of the effect of the adopted laws and the legislation on the course of socio-political, socio-economic, judicial and legal reforms, information on public satisfaction with efficiency of implementing norms of the legislation in practice.
During the event, participants:
- discussed the current state and prospects of development of processes of introduction of modern methods of assessing the impact of legislative acts in law and legislation activities of the Republic of Uzbekistan, in particular assessment systems of legislative acts impact;
- reviewed and analyzed the effectiveness of foreign and international experience, in particular the US, the EU and the Republic of Korea on the application of the assessment system of the legislative acts impact;
- developed recommendations on ensuring development of assessment system of the legislative acts impact, in particular, aimed at further improvement of the legislation regulating these processes;
- studied international and national practice of implementation of mechanisms of «feedback» of parliament with society, civil society institutions, experts, and others, in order to collect and analyze quantitative and qualitative information about processes of law enforcement;
Following an international workshop, proposals and recommendations on further improvement of the methodology for assessing the impact of legislative acts and normative-legal acts determining the procedure for the development and adoption of laws, the introduction of international standards in the process of adopting new, and monitoring the effectiveness of existing legislative acts of the Republic of Uzbekistan were developed.
