Uzbekistan abolishes unplanned and counter inspection of businesses

Tashkent, Uzbekistan (UzDaily.com) -- Controlling bodies of Uzbekistan cannot conduct unplanned and counter inspection of businesses entities from 1 January 2017.
Interim President Shavkat Mirziyayev signed a decree “On additional measures on ensuring fast development of entrepreneurship activity, all possible protection of private property and quality improvement of business climate” on 5 October 2016.
The decree is directed at further strengthening legal protection of private property, creating favourable conditions and all possible support to small and private businesses increasing investment attractiveness of Uzbekistan and improving quality of state policy in this direction.
The document said that providing more freedom to small and private businesses, decreasing interference to their activities with focus on preventing violations are priorities and paramount task of the state bodies.
The state bodies, first of all law enforcement and controlling agencies, were entrusted to ensure fill realization of set requirements and principle of priority of interests and rights of the businesses. They should re-consider their functions and authorities.
The state bodies should firmly execute legislation on responsibility of officials for illegal interference and prevention of the activities of the businesses and compensation for the damages, caused by their activities.
The norm obliges state bodies to use firm disciplinary, administrative or criminal responsibility to officials, who violated rights of businesses, with reimbursement of the losses of business entities.
The measures are directed to prevent illegal inspections, unfounded suspension of activities of businesses and damages in the result of activities of the state officials.
The decree said that all types of unplanned and cross inspections of the business entities will be abolished from 1 January 2017, except inspections in connection with liquidation of legal entities and conducted with permission of the Republican council on coordination activities of controlling bodies, initiated on request of individuals and legal entities due to violation legislation.
The controlling bodies now have no right to initiative unplanned inspection of the business entities.
The decree also exempts businesses and their workers from all types of responsibility, who committed violation of the legislation for the first time if they voluntary compensate damages within the set period.
The decree also set ban on use of criminal punishment like revoking right to conduct business activities in relation of businesses entities.
These norms will avoid double punishment of businesses and allow businesses entities, which committed violation for the first time, to continue their activities. These measures should boost business activities in the country.
In this connection, it is planned to introduce changes and amendments to Criminal Code, Administrative Responsibility Code, Tax Code and others.
Newly created production enterprises with foreign investment received right to use the rates of taxes and other mandatory payments for five years from the date of their registration. This norm will apply to all foreign enterprises, independently the volume of foreign investments.
The decree offered the Uzbek parliament to create Commissioner on protection of rights and interests of businesses under Oliy Majlis of Uzbekistan, which will protect interests and rights of business entities.
The decree approved the programme of complex measures on developing business activities and protection of rights of business entities. Overall, the programme includes 42 concrete measures on five priority areas.
The programme envisages improving legislative acts on fighting corruption, abolishing administrative barriers, etc.
It also stipulates measures on further liberalization of criminal legislation related to entrepreneurship activities.
Uzbekistan plans to introduce advanced market mechanism of currency regulation and currency policy, modern principles of regulating banking system, improve tax administration and abolish requirement to register export contracts at the customs bodies.
The programme also envisages strengthening of judicial protection of rights and interests of businesses entities via transferring functions and authorities of controlling bodies on applying of administrative punishments to business entities and their employees.
It is planned to improve services provided to business entities via Electronic Government system via expanding number of offered services.
