Uzbekistan proposes to legalize unauthorized buildings
The document was developed by the Ministry of Justice of Uzbekistan.
The draft decree said that the legislation guarantees the rights of citizens to individual housing construction on land plots granted on the right to lifelong inheritable possession.
It noted that despite the existence of legal mechanisms for acquisition and construction of housing, thousands of citizens illegally erected individual housing for many years on illegally occupied land plots.
In many respects this became possible due to connivance of state bodies, primarily executive bodies in the places, including those authorized in the field of land cadastre, architecture and construction, the document says.
Farmers illegally sold lands to people for construction of houses for fee, the document said.
The document proposes to declare, until 31 December 2018, one-time nationwide campaign to recognize property rights for residential premises of individuals erected on an unauthorized occupied land plot or without obtaining a construction permit.
The draft decree said that citizens should pay one-time fee equal to 10 sizes of minimal wages (1.7 million soums now) to recognize the ownership for an unauthorized structure.
After recognition of the rights of ownership of an unauthorized construction, the owners will receive right to lifetime inheritable possession of the land (part of the plot), on which their habitation were constructed.
After the expiration of the period of the action, the responsibility for construction of unauthorized buildings will be toughened. For their admission, the public prosecutor of Uzbekistan, the chairman of Jokarga Kenes Karakalpakstan, regional khokims and Tashkent, as well as officials of other authorized bodies will be personally responsible.
